Probe police officers in Sabah over power abuse, PCB told

KUALA LUMPUR: Minister in the Prime Minister’s Department Tan Sri Bernard Dompok has instructed the Public Complaints Bureau to conduct an immediate probe on allegations of power abuse by senior police officers in a land-grabbing issue at Kampung Tingkayu in Kunak, Sabah.

Dompok said the affected smallholder who had worked on the land for the past 23 years met him in Parliament on Tuesday and briefed him on the issue. “This is a very serious matter as it involves senior police officers. I’ve instructed the bureau’s director-general Dr Chua Hong Teck to look into the complaint.

“We guarantee a fair probe. The bureau will treat the complainant fairly as promised in the bureau’s clients’ charter,” he told Bernama yesterday. Dompok said the bureau would convene a special meeting this week to discuss the matter.

“If it is proven that the said police officers misused their power, stern action would be taken against them, as nobody is above the law.

“The bureau will be cooperating with other relevant agencies once the investigation started and all parties should give their fullest cooperation,” he said, adding that “we don’t want to see public trust towards the authorities fade.”

In April, Bernama reported that a top-ranking senior law enforcement officer holding the title of “Datuk” and police officers in Kunak, are being investigated by the Sabah Anti-Corruption Agency for allegedly offering “protection services” to a real estate company which allegedly seized 787 hectares (about 4,000 acres) of oil palm plantations belonging to smallholders. In exchange for their “services”, the company, which is also involved in money lending, had reportedly given the officers kickbacks and other benefits, including offering its company’s shares?

Bernama also reported that the company concerned had employed more than 100 illegal immigrants who doubled as thugs to seize the land worth about RM40 million and more then 40 police reports were lodged between January and March this year at the Kunak police station, but was not entertained. It is learnt that the state government would also be briefed on the issue as the smallholders have alleged that few officers of the land and survey department might be involved in the scandal.

Meanwhile, one of the smallholders who wished to be known as Anthony, 50, told Bernama that an official complaint letter was handed to the Home Ministry on Thursday.

“In the letter we have asked the minister Datuk Seri Syed Hamid Albar to take appropriate action against the police officers who failed to discharge their duty and abused their power.

“We have all the evidence to prove that the complaints made were true and we hope our nightmare will end soon,” he added.

Sabah Senior Politician And Cop Behind Land-grab?

KUALA LUMPUR, June 2 - With the Anti-Corruption Agency (ACA) and Public Complaints Bureau intensifying its probe into allegations of a RM40 million land-grab in Kunak, Sabah, two major "players" in the racket might come under scrutiny for alleged abuse of power.

One is believed to be a senior politician in Sabah, the other is a high-ranking official in the police force.

The Minister in the Prime Minister's Department Tan Sri Bernand Dompok on Sunday instructed the Public Complaints Bureau to immediately investigate allegations of power abuse by senior police officers in the land-grab issue.

Bernama learnt that the politician is among several which the Sabah ACA would call to facilitate investigations into the racket involving over 787 hectares of oil palm plantation in Kampung Tingkayu.

Sabah ACA director Latifah Md Yatim declined to comment on the two "masterminds" as investigations were underway.

"Let the ACA conduct its probe. We will surely inform the media on the latest development (of the case). My officers are gathering the relevant information and documents pertaining to the case," she told Bernama Monday.

The politician, in his 60's, is believed to have obtained a percentage of shares and money from a real estate company which allegedly seized the land belonging to 171 smallholders.

Bernama understands that the politician had instructed some senior officers from the Sabah Land and Survey Deparment not to entertain the smallholders who had urged the department to investigate the ownership of the seized land.

A team of Sabah ACA investigating officers will visit Kampung Tingkayu to gather vital evidence and interview the smallholders.

One of the affected smallholders, who wished to be known as Chong, 50, told Bernama that the politician refused to attend to the plight of smallholders who had been harassed by illegal immigrants on their plantations.

"Last month, we submitted an official complaint letter to the politician at his office on the activities of the illegal immigrants, but unfortunately he told us not to waste our time.

"We have all the evidence on this matter and we are ready to cooperate with the authorities," he said.

Kes Tingkayu, Bukti Kebodohan Polis

Kes pertikaian tanah seluas 4,000 ekar antara Syarikat Kerjasama Perkembangan Tanah Tingkayu Berhad (SKPTTB) dengan 171 pekebun kecil yang mendapat Perintah Injunksi daripada Mahkamah Tinggi Tawau pada 1 Februari 2008 membukti kebodohan Polis Malaysia.

Seorang Aktivis Masyarakat, O.K.K. Hassnar M.P. Ebrahim berkata demikian ketika diminta mengulas isu Tanah Tingkayu yang sudah berlarutan sejak lima bulan lalu.

"Sayalah orang yang memberi nasihat kepada Pekebun Kecil untuk bertindak dan bukannya takut kepada polis. Masa untuk orang awam hormat dan takut kepada polis telah berakhir. Jika CP ingin menangkap dalang pekebun kecil, tangkap dan dakwalah saya," ujar Hassnar yang mencabar PDRM menangkap beliau.

Cabaran berkenaan berpunca daripada tindakan Pesuruhjaya Polis Sabah, Datuk Noor Rashid Ibrahim telah memberi amaran yang keras kepada semua pihak agar jangan mencampuri urusan tanah di Tingkayu sehingga sanggup menuduh beberapa individu dan pertubuhan bukan kerajaan mendalangi para pekebun kecil dengan memberi nasihat yang salah dan  menghasut pekebun kecil melanggar undang-undang.

Kata Hassnar, melatahnya seorang Pesuruhjaya Polis Sabah tetapi masih berpangkat DCP, menunjukkan betapa tidak profesionalnya polis Sabah sejak mantan Pesuruhjaya Polis Sabah, Datuk Ramli Yusof terlibat dengan Skandal Tanah di Tanjung Labian, Lahad Datu yang kini masih dalam perbicaraan.

Menurutnya lagi, betapa sukarnya seorang Pesuruhjaya Polis Sabah memahami apakah itu Injunksi Mahkamah sehingga mudah dipengaruhi oleh Pengerusi SKPTTB, Hajjah Alinah Usman Suing dengan memutar belit fakta bahawa Mahkamah Tinggi Tawau telah memberikan hak tanah seluas 4,000 ekar kepada SKPTTB, membuktikan Noor Rashid adalah seorang peniaga polis ataupun polis yang berniaga dan bukannya layak menjadi Pesuruhjaya Polis Sabah. 

"Keputusan rayuan Perbicaraan Tanah di Mahkamah 2006 antara Yadum Atihal dengan Timbalan Pengarah Jabatan Tanah dan Ukur yang digunapakai oleh Hajjah Alinah untuk mempengaruhi Noor Rashid bahawa tanah tersebut milik SKTPPB adalah tidak sah dan tidak berkuatkuasa kerana tidak langsung merujuk kepada SKTPPB" ujar Hassnar yang mengibaratkan kesalahan trafik diguna pakai dalam kes dadah.

Tegas Hassnar lagi, stas sebab teknikal, Hakim Mahkamah Tinggi Tawau, Datuk Clement Skinner telah menolak rayuan pekebun kecil, namun menerima Saman Pemula Pekebun Kecil terhadap SKTPPB melalui Saman T (21) 4 Tahun 2008 yang difailkan pada 30 Januari 2008.

Clement Skinner kemudiannya telah meluluskan Injunksi Mahkamah kepada 171 Pekebun Kecil Tingkayu pada 1 Februari 2008 yang berbunyi;

"Adalah dengan ini Plaintif (Pekebun Kecil) diberi Injunksi untuk mencegah Defendan Pertama (Syarikat Kerjasama Perkembangan Tanah Tingkayu Berhad) sama ada bagi pihak mereka sendiri, kakitangan, pekerja atau agen atau sesiapa sahaja daripada menghalang Plaintif memasuki atau keluar daripada tanah tersebut dan menuai tanaman mereka di situ dan atau Defendan Pertama daripada meminta, mengambil atau menerima milikan kosong tanah tersebut yang kononnya diberi kepada Defendan Pertama di bawah geran CL 245361951 sehingga pembicaraan tindakan ini atau perintah lanjut oleh Mahkamah ini."

Namun kata Hassnar, Injunksi ini gagal difahami oleh Pesuruhjaya Polis Sabah dengan mengambil sikap menyebelahi SKTPPB iaitu mendakwa bahawa tanah yang menjadi pertikaian tersebut milik SKTPPB sedangkan Injunksi yang diluluskan Mahkamah Tinggi Tawau tidak membenarkan SKTPPB mendakwa tanah tersebut milik mereka sehingga kes mereka dibicarakan dan diputuskan mahkamah.

"Jika polis menghalang pekebun kecil masuk ke kebun mereka dengan pelbagai ugutan dan dalam masa yang sama membiarkan penjenayah bermaharaja lela, maka polis melakukan Malafide dan membantu penjenayah merampas hak pekebun kecil," kata Hassnar dengan nada kesal.

Dalam pada itu, dengan nada sombong, Noor Rashid Ibrahim mengugut akan menangkap pekebun kecil yang telah memfitnah polis dan membuat laporan palsu, termasuk menuduh kekacauan ini berlaku akibat tindakan empat orang peniaga Cina dari Semenanjung Malaysia yang telah melabur di tanah berkenaan dan mempunyai kepentingan politik dan peribadi.

Namun tindakan pantas Menteri Di Jabatan Perdana Menteri, Tan Sri Bernard Dompok yang mengarahkan Biro Pengaduan Awam menjalankan siasatan dan Menteri Dalam Negeri, Datuk Seri Hamid Albar menghantar sepasukan penyiasat dari Bukit Aman yang diketuai oleh Superintendan Chew dan ASP Fadzil telah menyebabkan Noor Rashid Ibrahim bagaikan 'Kucing hangus ekor'.

Walaupun siasatan terperinci dan menyeluruh Team Bukit Aman menjurus kepada Salahgunakuasa Polis, namun berjaya membongkar siapa sebenarnya yang terlibat dan menyaksikan sudah ada yang merasa pedas kerana tergigit lada!

Pengakuan Pengerusi SKTPPB, Hajjah Alinah di TV 3 memudahkan lagi 171 Pekebun Kecil mengambil tindakan Menghina Mahkamah bukan sahaja terhadap Alinah, malah Pesuruhjaya Polis Sabah, pekerja SKTPPB yang diupah untuk mencuri hasil pekebun kecil, malah Ketua Polis Daerah Kunak, Dingka Utoh yang mempunyai kepentingan di atas tanah berkenaan.

Mungkinkah akan berlaku pertumpahan darah di Tingkayu akibat tindakan balas pekebun kecil yang merasakan tiada lagi kedaulatan Undang-Undang di Sabah dan Keluhuran Perlembagaan telah dicabuli polis dan SKTPPB yang dilindungi polis?

Jawapannya hanya ada kepada Ketua Polis Negara, Tan Sri Musa Hassan yang kini masih mengerjakan Umrah dan akan memberikan sentuhan kecundang kepada Pesuruhjaya Polis Sabah yang kini sudah ada dalam senarai pertukaran besar-besaran PDRM.

Kereta OCPD Kunak disimbah cat

Salah sebuah daripada lapan buah kereta milik Ketua Polis Daerah Kunak, DSP Dingka Utoh telah disimbah cat ketika diletakkan di Pangkalan Pekan Kunak, satu kilometer daripada Balai Polis Kunak.

Namun Dingka atau pemandu kereta Landcruiser bernombor ST 3389 B tidak membuat laporan polis dan Dingka melarang semua media tempatan menyiarkan kes keretanya disimbah cat.
 
Mengikut makluman daripada beberapa orang saksi, landcruiser berkenaan dipandu oleh seorang bekas banduan yang berstatus pendatang asing tanpa izin, Andi, yang meletakkan kenderaan tersebut di Pangkalan Kunak sebelum memasuki sebuah rumah untuk membeli syabu dan menghisap syabu di rumah berkenaan dan tertidur sehingga keesokan harinya.

Memandangkan kawasan berkenaan agak gelap, maka ianya memudahkan pihak yang bersengketa dengan Andi atau Dingka menuang cat kilat berwarna aluminium ke bumbung dan bonet kereta sehingga cermin hadapan dilimpahi cat.
 
Kereta berkenaan tidak dapat dipandu kerana cerminnya dipenuhi cat menyebabkan Dingka mengupah sebuah kereta tunda untuk menarik kereta tersebut pada jam 8 malam berikutnya ke sebuah lokasi yang tidak diketahui.
 
Dipercayai kereta berkenaan tidak mempunyai sebarang insuran, cukai jalan dan dipandu oleh Andi untuk berulang alik ke kebun Dingka di Simpang Empat Kunak dan Sungai Kambing, Tingkayu.

Peristiwa ini telah menyebabkan Dingka kehilangan maruah sebagai OCPD kerana ada orang berani menyimbah keretanya dengan cat di khalayak ramai sehingga menjadi buah mulut bagi Kunak dan kawasan sekitarnya.

"Memang memalukan. Berani betul orang yang simbah cat ke kereta OCPD. Walaupun ianya kelihatan seperti memberi amaran, namun ada sesuatu yang tidak kena dengan Dingka dan Polis Kunak," ujar Haji Hussin yang turut menyaksikan kereta Dingka dikerumuni orang ramai di Pekan Kunak.
